1.4. By using the Website, you agree to these Terms. If you do not agree, please stop using the Website.
2. Website information and medical disclaimer
2.1. Website content is provided for general information and education. It is not a substitute for an individual medical assessment, diagnosis or treatment.
2.2. If you have new, severe or worsening symptoms, or are unsure whether an exercise or service is suitable for you, seek advice from an appropriate healthcare professional before taking part. In an emergency, contact the emergency services.
2.3. We take reasonable care to keep Website information accurate and current, but we do not guarantee that all content will always be complete, error-free or suitable for every person.
3. Bookings and service-specific terms
3.1. A booking is subject to availability and is not confirmed until you receive confirmation through the relevant booking system or directly from Pro-align.
3.2. Prices, session details, eligibility requirements, cancellation arrangements and any service-specific conditions will be shown on the relevant service or booking page, or provided before your booking is confirmed. Those service-specific terms form part of your agreement with us.
3.3. You are responsible for providing accurate information and for telling us about relevant health conditions, injuries, symptoms or changes that may affect your safe participation.
3.4. We may refuse or stop a session where we reasonably believe participation would be unsafe, inappropriate, unlawful or disruptive. Where appropriate, we may recommend that you seek medical advice or another service.
4. Online purchases, digital content and cancellation rights
4.1. If you buy products, services or digital content online, we will provide the price, payment information and any applicable delivery, access, cancellation or refund terms before you place the order.
4.2. Nothing in these Terms affects your statutory rights under UK consumer law, including the Consumer Rights Act 2015 and, where applicable, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
4.3. Some distance purchases may include a 14-day cancellation right. Different rules may apply to services requested to begin during that period and to digital content supplied immediately. Where your cancellation right is affected, we will ask for the acknowledgement or consent required by law before supply begins.
4.4. To ask about cancellation, refunds or access to a purchase, contact sally@pro-align.uk. Any service-specific cancellation policy presented before booking or purchase also applies, provided it does not limit rights that cannot lawfully be excluded.
5. Your use of the Website
5.1. You may use the Website only for lawful, personal and non-commercial purposes.
5.2. You must not attempt to disrupt the Website, gain unauthorised access, introduce malicious code, scrape or reproduce substantial parts of the Website, or use its content in a misleading or unlawful way.
6. Intellectual property
6.1. Unless stated otherwise, the Website and its content—including text, graphics, logos, photographs, videos, downloads, course and workshop materials, code and design—are owned by or licensed to Pro-align and are protected by applicable intellectual property laws.
6.2. You may view, temporarily store and print Website pages for your own personal, non-commercial use. You must not reproduce, republish, sell, distribute, adapt, broadcast or commercially exploit our content without prior written permission.
7. Privacy
7.1. Our use of personal information is explained in our Privacy Policy.
8. Third-party websites and services
8.1. The Website may link to third-party booking systems, payment providers, video platforms, social networks or other websites. We do not control third-party content or availability. Their own terms and privacy policies may apply.
8.2. A link does not mean that we endorse every statement, product or service on the linked website.
9. Availability and changes
9.1. We may update, suspend or withdraw Website content or features where reasonably necessary. We do not guarantee uninterrupted availability.
9.2. We may update these Terms from time to time. The revised Terms will apply from the date shown at the top of this page. Changes will not retrospectively remove rights you already have under a confirmed contract.
10. Liability
10.1. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any consumer right that cannot lawfully be excluded.
10.2. If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable, losses caused by information you failed to disclose, or business losses arising from consumer use of the Website or Services.
10.3. We are not responsible for delays or failures caused by events outside our reasonable control, but this does not affect any legal remedies available to you.
11. Governing law
11.1. These Terms are governed by the laws of England and Wales. If you live elsewhere in the United Kingdom, you may also have the benefit of mandatory protections and may be entitled to bring proceedings in your local courts.
